Vivid Will Ignore Ashton Kutcher Legal Letter

Vivid has been promoting the release of its latest ‘celebrity sex tape’. Except, this tape doesn’t actually feature a celebrity; only some random wandering vagina, who claims to have bedded one. The sex tape was released only days ago, and very quickly the legal team of Ashton Kutcher sent a cease and desist-type notice (PDF) demanding the adult entertainment company stop using his name to shill their tape as follows: ‘Ashton’s fans will undoubtedly enjoy seeing what the star himself may have experienced’. If nothing else, there’s still no proof he ever had an affair with Brittney Jones, who claimed to be his mistress. For some reason, the focus of his legal letter seemed to be damage to his reputation, ‘[the use of his name in association with the tape is infringing on the actor's] marketable celebrity identity value.’ Vivid executive Steve Hirsch has followed up to his initial response of ‘We received the letter late this afternoon and I immediately forwarded it to my attorney. We will respond accordingly’, with a letter (PDF) telling Kutcher to get lost. In Vivid’s reply, they claim it’s not their fault Kutcher has a negative reputation at the moment, and the rumours aren’t their doing. Clarifying that he should get over it because the accusations are old.
